The book Inside the Hollywood Fan Magazine by Anthony Slide states that "Photoplay's' back issues from the so-called "Golden Age" [are] all in the public domain" - see page 71. This seems to be confirmed by the Internet Archive, which includes all of the magazine's issues from January-June 1940.
